The owner and administrator of the online store located at www.magicprint.ie is MAGIC PRINT, a company based in Carlow Town.

Please read these terms and conditions carefully before ordering any products from our site. You should understand that by ordering any of our products, you agree to be bound by these terms and conditions and that these are the only conditions that apply to the contract notwithstanding any purported terms put forward by you.

The conclusion of the sales contract comes at the moment of confirmation of the Order by the Customer through a return mail confirming the acceptance of digital submission of artwork sent by the Customer to MAGICPRINT, and the payment is credited to the account or credit / debit card authorization unless credit facilities have been approved with us in advance of the order. Payment on pre-approved credit accounts shall be made in full within 30 days of invoice. Credit facilities may be withdrawn without notice.

Artwork Approval

The information on the MAGICPRINT website does not constitute an offer within the meaning of the Civil Law. When placing an order, the Customer submits a purchase offer for a specific item/s, makes payment and send to us logo design or data which are going to be imprinted on the product/s. Condition of the order fulfillment is acceptance off your artwork. We will send you an artwork approval form via email illustrating how your artwork will look on your chosen product, which can be changed multiple times until you are satisfied with the design.Please make sure that your data (phone numbers, email addresses, spelling, etc.) match your order. By email acceptance of the received artwork, any claims of incorrect information contained in the imprint will not be subject to complaint.

The MAGIC PRINT is not responsible for the extended approval time of the Ordering Party.

Use of Trademarks and Designs Submitted to MAGIC PRINT

Any company or individual ordering custom-imprinted merchandise from MAGIC PRINT, warrants and represents that you are the sole, legal owner or licensee of all rights, including copyright, to each trademark, logo, statement, or any other intellectual property included in the design you instruct us to have imprinted on the merchandise you purchase. Furthermore you warrant that the designs you approve for reproduction are in accordance with the guidelines of the owner of said trademark or logo.

You warrant and represent that no part of the design violates or infringes upon the rights of any person or entity nor is it subject to any restriction or right of any kind or nature whatsoever which would prevent MAGIC PRINT from legally reproducing the images or text submitted.

You agree to defend, at your sole expense, any claim, lawsuit, or proceeding brought against MAGIC PRINT products for reproduction of the trademarks, logo or written information you supply to us which constitutes wrongful use of any copyright, trademark, or other right of any third party. MAGIC PRINT shall not be held liable for the unauthorized, improper, or illegal use of any logo or trademark that is applied to promotional merchandise purchased from us. Further, MAGIC PRINT will not accept liability for the actions of clients who have misrepresented their ownership of licenses or trademarks.

Reproduction of Trademarks and Logos on MAGIC PRINT

All items shown on our web site containing corporate logos or registered trademarks are shown only to illustrate the logo reproduction capabilities of the companies that produce the respective merchandise displayed on our site. The illustration of any trademark on our site does not constitute any endorsement by MAGIC PRINT on behalf of the owner of said trademark or design.

Pricing & Availability

Because of the fast-moving nature of the Promotional Products Industry, prices and availability are subject to change without notice. If a product is not in stock when you place your order (for example, not yet available or sold out), we will do our best to let you know when we anticipate the product will be available. Anticipated delivery dates are dependent upon vendor supplies and other factors and are subject to change. MAGIC PRINT reserves the right to deliver +/- 1% of the ordered quantity of goods. Prices published in the price list on magicprint.ie are net prices, which are subject to VAT at the current rate where applicable. By placing an order, the Customer agrees to receive invoices by electronic means. The customer also has the opportunity to receive paper invoices after having made a prior written request from him.

Product Images Displayed on Magic Print

We warrant that we have not altered or enhanced any images shown on our web site to misrepresent the true nature of the product displayed. We strongly urge our customers to request samples of the products they are considering for purchase to ensure that the colour and quality meet their requirements for distribution.

Product Colour / Colour Matching

The colour of products viewed online may vary slightly from the actual product due to an incorrect calibration of colours in your monitor. If you require a sample, please contact us. In the event that exact Pantone or CMYK colour information is not provided with your artwork file(s) MAGIC PRINT will take all care to match as closely as possible to your artwork. MAGIC PRINT is not responsible for colour printing, which due to the colour and type of substrate may slightly differ from the Pantone colour scale. The correct colours of Pantone prints are possible to obtain primarily on a white substrate, which the MAGIC PRINT informs the Customer about. Obtaining the required colour effect may require additional costs associated with ordering special Pantone paints or making a white liner.

Shipping Delays

MAGIC PRINT shall not be held responsible for delays in delivery resulting from acts of God or other circumstances beyond our control. Our specified ship dates for your order(s) are based on the representations of the factory where your merchandise is produced. We will not be held liable for any special damages or consequential claims that exceed the invoiced value of the merchandise purchased if merchandise is not shipped on the specified date or is delayed in transit

Warranties

We warrant that all merchandise sold to you by MAGIC PRINT is free of any security interest. We shall make available all transferable warranties from the manufacturer of the merchandise available to you, the buyer. We do not express or imply any warranties as to the fitness for purpose of the merchandise you purchase from us.

Cancellation or Changes to Existing Orders

Once you have confirmed the digital submission of artwork, we cannot guarantee that we will be able to make changes to or cancel your order without incurring charges. This will depend on the extent of work the producing factory has performed on your order. We will advise you by email of any and all costs incurred prior to making changes or cancellations with the factory. You will be responsible for payment of those charges without dispute. Should you cancel your order with MAGIC PRINT prior to the commencement of production by the factory, you will be charged a processing fee for the work we have done to place your order into production plus proof charges if applicable.

Claims, Adjustments & Returns

Should you have any problems with your order, please contact at [email protected] within 48 hours of receipt of your merchandise. We urge you to inspect your merchandise upon arrival in order to facilitate the resolution of any claims. Do not return the merchandise to us without receiving a Return Authorization as it will be refused. If you receive a Return Authorization we will advise the correct shipping address for your return. We will assist you in resolving your claim if your order has not been produced as requested or is defective in manufacture. Claims for merchandise damaged in transit must be resolved with the carrier.
